These Terms of Service ("Terms") govern your access to and use of the SkipSchool website, applications, and services (collectively, the "Service") provided by SkipSchool ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. 1. DESCRIPTION OF SERVICE SkipSchool is an AI-powered platform designed to provide educational assistance, help users understand complex topics, generate examples, and offer tools for content interaction and creation. The Service utilizes third-party artificial intelligence models to process user queries and generate responses. 2. ELIGIBILITY AND ACCOUNT REGISTRATION 2.1. Eligibility: You must be at least 13 years old to use the Service. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms. 2.2. Account Creation: To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process. 2.3. Account Security: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with this security obligation. 2.4. Account Sharing: Your account is for your personal use only. You may not share your account credentials with any other person or entity. 3. USER CONDUCT AND RESPONSIBILITIES 3.1. Acceptable Use: You agree not to misuse the Service or help anyone else to do so. You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. 3.2. Academic Integrity: The Service is intended to be used as a study and learning tool. The outputs generated by the AI are meant to assist with understanding, brainstorming, and learning. You acknowledge that submitting AI-generated content as your own original work may constitute a violation of the academic integrity policy of your educational institution. You are solely responsible for how you use the content generated by the Service and for ensuring that your use complies with all applicable academic policies. Features such as "Humanize" or "Safety Tips" are provided for educational and illustrative purposes to demonstrate how AI-generated text can be analyzed and modified; they are not an endorsement or encouragement of academic dishonesty. You assume all risks and consequences related to academic penalties that may arise from your use of the Service. 3.3. Prohibited Activities: You agree not to: a. Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service. b. Use the Service for any illegal or unauthorized purpose, including but not limited to, activities that violate copyright, trademark, or other intellectual property laws. c. Upload, transmit, or distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable. d. Upload or transmit any malicious code, viruses, worms, or any software intended to damage or alter a computer system or data. e. Interfere with, disrupt, or create an undue burden on servers or networks connected to the Service. f. Attempt to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service. 4. USER-GENERATED CONTENT 4.1. Your Content: You retain ownership of any intellectual property rights that you hold in the content you submit to the Service, such as prompts, uploaded files, and custom instructions ("User Content"). 4.2. License to Us: By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with operating, providing, and improving the Service. This license is solely for the purpose of providing and enhancing the Service. 4.3. Temporary Files: Files uploaded to the Service are processed to generate a response and are stored temporarily. We do not claim any ownership over your uploaded files and take measures to delete them from our active systems after a reasonable period following the completion of your request. 5. SERVICE PLANS, PAYMENTS, AND INVITATIONS 5.1. Service Plans: We offer different tiers of service, including a free plan with usage limitations and one or more paid "Pro" plans. The features and limits of each plan are subject to change and will be described within the Service. 5.2. Payments and Subscriptions: Paid plans are processed through our third-party payment processor, Gumroad. By purchasing a Pro plan, you agree to Gumroad's terms and conditions. We do not collect or store your payment card details. 5.3. License Keys: Access to Pro plans may be managed through license keys. You are responsible for the security of your license key. License keys may have limitations on the number of accounts they can be applied to. 5.4. Invite System: We may offer a referral program where you can invite others to the Service. Such programs may grant you and/or the invited user temporary access to Pro features. We reserve the right to modify or terminate the invite system and any associated rewards at any time. We reserve the right to revoke rewards and terminate accounts found to be abusing the system through self-referrals or other fraudulent activities. 6. INTELLECTUAL PROPERTY 6.1. Our IP: All rights, title, and interest in and to the Service (excluding User Content), including all associated intellectual property rights, are and will remain the exclusive property of SkipSchool and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries. 6.2. AI-Generated Content: The ownership of output generated by artificial intelligence is a complex and evolving area of law. We do not claim ownership of the responses the AI generates for you. You may use the generated content for any purpose, subject to your compliance with these Terms, particularly the User Conduct and Academic Integrity sections, and any applicable laws. 7. THIRD-PARTY SERVICES The Service integrates with and relies on third-party services, including but not limited to AI model providers (e.g., Google, OpenAI), payment processors (e.g., Gumroad), and authentication services (e.g., Google OAuth). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the performance, availability, or security of any third-party services. 8. TERMINATION 8.1. By Us: We may suspend or terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately, if we believe, in our sole discretion, that you have violated these Terms. 8.2. By You: You may stop using the Service at any time. If you have a Pro account, you may cancel your subscription according to the terms of our third-party payment processor. 9. DISCLAIMER OF WARRANTIES THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS, OR THAT THE INFORMATION OR CONTENT GENERATED BY THE SERVICE WILL BE ACCURATE, RELIABLE, COMPLETE, OR TRUTHFUL. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING THE ACCURACY OF ALL GENERATED CONTENT. 10. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SKIPSCHOOL, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR (A) ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; OR (B) ANY DAMAGES FOR PERSONAL OR BODILY INJURY, EMOTIONAL DISTRESS, OR ACADEMIC PENALTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF SKIPSCHOOL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS, FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, IS LIMITED TO THE GREATER OF (I) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE CLAIM OR (II) ONE HUNDRED U.S. DOLLARS ($100.00). 11. INDEMNIFICATION You agree to defend, indemnify, and hold harmless SkipSchool and its affiliates, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. 12. GOVERNING LAW AND DISPUTE RESOLUTION These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration in Delaware, in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS"). You and SkipSchool waive any constitutional and statutory rights to go to court and have a trial in front of a judge or a jury. YOU AND SKIPSCHOOL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. 13. CHANGES TO TERMS We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. 14.
